1. Binding Agreement. This Service Contract ("Contract") is a legally binding document between the service contract holder ("You" or "Your") and AMERICAN HANDY PAINT AND CLEAN CO. ("AHPC"). This Contract constitutes the entire and only agreement between You and AHPC. This Contract provides for home service contract with AHPC only and should not be confused with an insurance contract or warranty. This Service Contract includes services to be performed at one address only cannot be transferred to a different home or property.
2. Term. The term of Your Service Contract Membership is one year and begins upon receipt of payment of the Membership Fee. Your credit card on file will be charged for any completed jobs, and a $100 cancellation fee will be charged for any jobs not cancelled with 24 hour notice. Invoices are due at time of receipt.
3. Service Call Fee. A Service Call Fee of $70.00 must be paid to AHPC at the time and place of each Service Call appointment. The Service Fee must be paid for each Service Item, as specified in paragraph 4 below, per visit. Cost of appliances, fixtures, and/or parts is not included in this Service Contract and is Your sole responsibility. The Service Call Fee is in addition to the Membership Fee. Service fees will be increased to $65.00 per visit, per item commencing January 1st 2021 . All members enrolled prior to January 1st 2021 shall receive one (1) year worth of service from date of enrollment at the original $40 fee.
4. Service Items. The following Service Items are the services that are included in this Service Contract. Appliances, fixtures, and parts are not included unless otherwise specified in this Contract.

   Annual Plan A - $150.00 per year

   2. Ceiling Lamp Replacement
   3. Dishwasher Replacement
   4. Electrical Outlet Replacement
   5. Electrostatic Disinfection
   6. Furniture Assembly
   7. Light Switch Replacement
   8. Microwave Replacement
   9. Pressure Cleaning - Driveway
   10. Pressure Cleaning - Home
   11. Refrigerator Replacement
   12. Small Moving Project
5. Access. It is your responsibility to provide access to the system or appliance in need of repair. In the event that the system or appliance cannot be accessed without causing damage to a wall, floor, cabinet or ceiling, AHPC will not cover and will not be responsible for any wall coverings, floor coverings, cabinets, counter tops, tiling, paint, or for the repair of any structural or cosmetic defects, including, but not limited to, reconfiguring space to accommodate replacement components.
6. Delay. AHPC will not be responsible for delays in repairing or replacing a system or appliance resulting from events beyond its control, including, but not limited to weather conditions, labor disputes, strikes, delivery problems, war or availability of parts.
7. Automatic Renewal. This Service Contract will be automatically renewed at the same terms per renewal terms unless you opt out in your subscription settings and/or cancel at least 15 days before the renewal date.
8. Arbitration. Any disputes resulting from this Contract or AHPC's services shall be construed and enforced under the laws of the State of Florida. You hereby submit to the jurisdiction of the courts of Miami-Dade County, State of Florida and waive any objection to venue with respect to actions brought in such courts. Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of or connected with this Agreement shall be resolved individually, without resort to any form of class action, and exclusively by the American Arbitration Association in Miami-Dade County, Florida.

AHPC reserves the right to delete any item which in the future may be considered or become obsolete, AHPC also reserves the right at it's sole discretion to add additional services which add value to it's members, as well as sub contract for any service in order to meet it's servicing responsibilities to it's members.
